Can I Mail Cannabis Gifts?
In a word, no. Even if cannabis is legal in your state or is legal in the state to which you are sending the package, cannabis remains illegal at the federal level. This automatically rules out using the U.S. Postal Service. The punishment for mailing “drugs” through the U.S. mail can include up to a year in federal prison and a fine of up to $250,000. It is also ill-advised to use private carriers like FedEx and UPS as it violates their respective terms of service. In addition, USPS, FedEx, and UPS employees are offered a “reward” of up to $50,000 from the federal government for information about persons mailing illegal substances. To sum it up, being prosecuted for mailing cannabis may result in Canna Claus delivering an expensive lump of coal to you in a federal jail cell. That’s not exactly keeping with the holiday spirit.
Is Flying with Cannabis Legal?
If you’re traveling with gifts during the holiday, remember that cannabis is illegal at the federal level and it’s a risk to carry it with you on a flight. Los Angeles International Airport (LAX) permits individuals 21 years of age or older to possess up to 28.5 grams of marijuana and 8 grams of concentrated marijuana for personal consumption. However, and that’s a big HOWEVER, TSA (federal employees) may turn you over to LAX Airport Police. The hitch is that LAX police officers will not arrest you for cannabis possession if you’re compliant with California state law. Logan Airport in Boston permits cannabis on the premises similar to LAX, but surprisingly, Denver airport does not. So, while Canna Claus is not subject to federal law or TSA screenings, everyone else should take heed.
